On February 27, 2007, the Ethics Committee of the Colorado Bar Association issued Ethics Opinion 115, relating to Ethical Considerations in the Collaborative and Cooperative Law Contexts. The Committee concluded that "[t]he Colorado Rules of Professional Conduct prohibit a lawyer from participating in Collaborative Law so long as a contractual obligation exists between the lawyer and the opposing party whereby the lawyer agrees to terminate the representation of the client." This Opinion arrives independently at the same conclusion reached in my earlier article from the May, 2002, Wisconsin Lawyer explaining collaborative divorce malpractice liability.
